  • Types of Products We primarily offer glassware, drinkware, and related products (collectively, the “Products”).

  • Pricing All prices displayed on our Website are in U.S. dollars unless otherwise stated and are subject to change without notice.  
  • Availability All products listed on our website are subject to availability and may be discontinued at any time. 
  • Accepted Payment Methods We currently accept Visa, MasterCard, and American Express. There are no additional surcharges for credit card payments. 
  • Taxes Sales tax (or other applicable taxes) will be calculated and added at checkout when shipping within the United States. For international orders, customers are responsible for any customs, duties, or other fees required by their local jurisdictions. 
  1. Shipping and Delivery
  • Shipping Scope We ship both domestically (within the United States) and internationally (to most countries). Shipping fees and applicable taxes will be added to your order total. 
  • Order Processing We strive to process orders promptly. Estimated shipping and delivery times are when you contact us regarding international shipments but are not guaranteed.  
  • Delivery Delays Govino is not responsible for delays caused by shipping carriers or customs processing.  
  • Title & Risk of Loss Title to and risk of loss of Products pass to you upon delivery to the carrier. 
  1. Returns and Refunds
  • Return Window If you are not satisfied with your purchase, you may return the item within 30 days of receipt in its original condition.  
  • Exceptions Custom orders are non-refundable unless the items are incorrect or arrive damaged. 
  • Refund Processing Upon receiving and inspecting the returned items, we will process any applicable refunds. The refund will be issued to the original payment method.  
  • Return Shipping Costs Shipping costs are non-refundable unless the return is due to our error. More information can be found on our Returns and Exchanges page.

  • No Express Warranties Unless otherwise stated, all Products are sold “as is,” without any express or implied warranties, including but not limited to implied warranties of merchantability or fitness for a particular purpose, to the fullest extent permissible by law.  
  • Usage & Safety Any usage instructions provided are suggestions only, and Govino shall not be liable for damages arising from misuse or improper handling. 
  • Fullest Extent Permissible To the fullest extent permitted by law, Govino, LLC, its affiliates, directors, employees, or agents shall not be liable for any indirect, incidental, consequential, special, or punitive damages, or any loss of profits or revenues, arising from or related to your use of the Website or purchase of our Products.  
  • No Liability for Certain Damages This limitation applies to all claims, whether based on warranty, contract, tort (including negligence), or any other legal theory. 
  • Consumer Protections Some jurisdictions do not allow certain disclaimers or limitations of liability. In such cases, our liability will be limited to the maximum extent permitted by applicable law.

  1. Dispute Resolution: Mediation & Arbitration 
  • Governing Law These Terms and any dispute or claim arising out of or in connection with them are governed by the laws of the State of California, without regard to its conflict of law provisions.  
  • Mediation Requirement The parties agree to mediate any and all disputes relating to or arising out of these Terms or the purchase and use of our Products before resorting to arbitration or court action.  

The mediation may be conducted using a mutually chosen mediator or mediation service. If the parties cannot agree, they shall use the services of the American Arbitration Association (“AAA”), which will select the mediator.  

The parties shall share evenly any and all mediation fees, costs, and expenses. Unless otherwise agreed in writing, mediation shall occur in Sacramento, California.  

  • Arbitration If a dispute or claim is not resolved through mediation, the parties agree to submit the matter to binding arbitration.  

There shall be one arbitrator. Unless otherwise agreed in writing by the parties, the arbitrator shall be a retired judge or justice, or an attorney with at least ten (10) years of experience as a California lawyer. If the parties cannot agree on an arbitrator within thirty (30) days from the date one party notifies the other in writing of a dispute, the parties shall submit the dispute to AAA and allow AAA to select the arbitrator.  

Unless otherwise ordered by the arbitrator, the parties shall share evenly the costs of arbitration. Unless otherwise agreed by the parties in writing, arbitration shall occur in Sacramento, California.  

  • Court Actions Except as may be required by the arbitrator’s order or if a matter is deemed non-arbitrable, any legal actions shall be filed in the state or federal courts located in California, and you consent to the jurisdiction of such courts. 
  1. Modifications and Notice
  • Changes to Terms We reserve the right to modify these Terms at any time. Any changes will be effective immediately upon posting the updated Terms on this page.  

Your continued use of the Website or purchase of Products after such modifications constitutes your acceptance of the revised Terms.  

  • Effective Date The “Last Updated” date at the top of this page reflects the most recent revision date of these Terms.

  • Entire Agreement These Terms, together with our Privacy Policy, constitute the entire agreement between you and Govino regarding your use of the Website and purchase of Products, superseding any prior agreements.
